Egyptian Prime Minister Offers Patronage to Imaging Consumables Expo

Following the news last week that the Ministry of Trade and Industry was supporting the RT Imaging Summit & Expo—EMEA in Cairo, comes more news that the Egyptian Prime Minister has stepped in.


His Excellency Sherif Ismail wants the whole Egyptian cabinet to get behind the international event to be held at InterContinental Hotel CityStars Cairo in Egypt on March 22–23, 2018. “I welcome the international copier and printer industry to our beautiful country. Egypt is a good destination to do business.” The Egyptian Prime Minister has now offered the entire government’s official patronage of the event that is bringing participants from 55 countries, some as far away as China.

The RT Imaging Summit & Expo—EMEA (RTISE—EMEA), launched in Egypt in 2017, is the only dedicated copier and printer consumables event in the EMEA region. David Gibbons, Director of RT Media, expressed his delight at the Prime Minister’s support. ”The government’s endorsement and presence at the expo is guaranteed to attract media attention and wide exposure to the printing consumables industry in the Middle East, Africa and Europe.” He indicated the RTISE—EMEA in Cairo will provide a one-stop business platform for the imaging industry. “Despite economic declines and a slowdown in the demand for printing in some regions of the world, the economy and demand in many EMEA countries, especially Egypt, has been growing. World Imaging Virtual Conference Connects Global Players

Six (6) imaging industry experts from the USA, Germany, China and Japan have shared highly sought-after technical, legal and trends information related to toners, chips and printer cartridges.


The 2018 World Imaging Virtual Conference —organized by Recycling Times Media Corporation (RT Media) and Galliford Consulting & Marketing— was held online, allowing each presenter to be visible to the audience from their home location. Participants were also able to communicate with each of the speakers in real time.

Unlike previous summits, held in conjunction with the RemaxWorld Expo and the expos in the Americas and EMEA, RT Media created an online platform that transcended geographical boundaries. The virtual conference made it possible for participants to attend without travelling from their home or office.

Naohiro Naito, AT-SX Market Cluster Manager of Nippon Aerosil, stated that snowman shaped fumed silica particles better improve the flow and durability of toner in use. Snowman particles can be dispersed well onto the toner surface, to bring good durability and environmental stability to toner.

Speakers also shared their own opinions about the industry. Volker Kappius, CEO of Delacamp AG, said, “Considering the use of materials, remanufacturing is one of the most preferable alternatives because the geometrical form of the product is retained and its associated economic value is preserved.”

New Brother Partner Program Aimed at Developing New Mobile-Printing Solutions

            According to Wirth Consulting, Brother International’s Brother Mobile Solutions group reports that it’s introduced a new mobile-printing development program, “THE NEXT” Partner Program, that’s designed to create new partnerships for advancing mobile printing. Designed to capitalize on the rapid expansion of the mobile workforce, the program is said to promote co-development of software and mobile-printing solutions.

RICOH PARTNERS WITH STRATASYS

Stratasys Partners with Ricoh for Distribution in New Zealand

            In a move to further strengthen its presence in New Zealand, Stratasys Asia Pacific, a subsidiary of Stratasys Ltd. (NASDAQ: SSYS), has entered into a partnership with Ricoh New Zealand Ltd. (Ricoh New Zealand), a subsidiary of Ricoh Company, Ltd. Japan. The collaboration will cater to the demand for 3D printing solutions in the region. Financial terms of the deal remain undisclosed.

            Ricoh will be representing the entire Stratasys product line, in addition to the existing MakerBot line. The collaborations with Ricoh for the adoption of 3D printing solutions are likely to reap synergistic benefits going forward. Partnering Ricoh will be a positive for Stratasys.

Ricoh New Zealand’ experience in offering office imaging, production printing, IT services and document solutions will perfectly complement the robust manufacturing expertise of Stratasys’ 3D printing domain, helping the latter in innovative additive manufacturing initiatives. Therefore, it will help Stratasys gain competitive advantage over players like 3D Systems Corp.

            Zacks Equity Research, which first reported the news, believe that the collaboration will expand and enhance Stratasys’ additive manufacturing (AM) or 3D Printing Platform. Also, this association will enable Stratasys to attract new clients and strengthen its overall market position.

NEW WAY TO PRINT LUMINOUS HOLOGRAMS

Nanoparticle Ink Lets Regular Inkjet Printers Produce Glowing Holograms

            Researchers at ITMO Universityhave unveiled a new approach to printing luminescent structures based on nanoparticle ink. The unique optical properties of the ink were achieved by means of europium-doped zirconia. Particles of this material were proven to be useful in manufacturing glowing holographic coatings with a high degree of protection. Notably, the developed approach enables the fabrication of custom holograms by means of a simple inkjet printer. The results of the research were published in RSC Nanoscale.

            The idea of Inkjet printing using functional nanoparticles has been gaining a lot of traction in recent years. Due to a number of advantages – lack of toxicity, high refraction index and high quantum yield  – luminescent nanoparticles are finding more applications in the fields of photonics, theranostics and bioimaging; they are used to produce biosensors, visualize cancer cells and in security printing technology. But to implement lab-made solutions on a bigger scale, a number of steps need to be taken to ensure proper functionality and stability during long-term storage of holograms.

The new ink developed by the scientists from ITMO University possesses characteristics that address precisely these issues. In a series of experiments the material was used for printing monolayers of luminescent-protected holograms and anti-counterfeiting objects with high stability and durability.

The authors note that the product is ready for practical application. The ink is compatible with currently-existing printhead types and can be used with existing manufacturing capabilities.

            “Europium-doped zirconium dioxide is a material that has been studied and used by researchers all over the world for decades. However, our research is novel in that it uses the material to protect the surface of rainbow holograms. To this end, we had to achieve certain features in the material. In particular, the nanoparticles contained in the ink must be close to identical in size. Strict requirements are also imposed by rheological parameters that determine the viscosity of the material – otherwise, the ink might not be suitable for inkjet printing. Our goal was to transform a material that was initially synthesized in a test tube into a stable colloid that could be printed and applied to any surface. Our study describes the exact process of creating such functional ink,” – comments Alexandr Vinogradov(pictured), co-author of the research and head of ITMO University’s Biochemistry Cluster.

            This is far from the first research into inkjet printing of luminescent optical nanostructures that has been done atITMO University. The study builds on previous work conducted as part of a bigger project funded by the Russian Science Foundation. Earlier, the scientists developed the world’s first method of printing holographic images using an inkjet printer. Back then, the team used ink based on titanium dioxide.

One of the most promising applications for the new ink is in the field of security printing –  such as polygraphic manufacture of bills, bonds and documents. Unlike the existing technologies, the new method makes it possible to create varied individual holograms on industrial scale – for instance, a specific pattern or a number sequence on a document that requires protection.

MONOCHROME DEVICES SHIPMENTS MARK GROWTH OF 19.1%

Worldwide Hardcopy Peripherals Shipments Continue to Show Modest Growth in the Second Quarter

As reported by IDC, the worldwide hardcopy peripherals (HCP) market grew 0.7% year over year with more than 23.3 million units shipped in the second quarter of 2017 (2Q17), according to the International Data Corporation (IDC) Worldwide Quarterly Hardcopy Peripherals Tracker. Inkjet and laser unit shipments both expanded in the quarter, growing 2.9% and 1.7% year over year, respectively.

Notable highlights from the quarter include:

HP Inc. remained the top HCP company with 1.3% year-over-year shipment growth. Second-ranked Canon, third-ranked Epson, and fourth-ranked Brother also saw positive year-over-year growth, while fifth-ranked Samsung declined 5.7% year over year.

Monochrome laser 21-44 ppm devices recorded year-over-year growth of 19.1% in unit shipments. The double-digit expansion was helped by strong performances from the top companies, especially HP Inc. and Canon.

Brother enjoyed the largest year-over unit gain, increasing 4.6% to more than 1.7 million units shipped. This was largely due to its strong growth within the Asia/Pacific (excluding Japan) region where it changed its channel strategy to provide a wider range of products to its office automation channel partners.

HP Inc. enjoyed 1.3% year-over-year growth in global shipments with a particularly strong performance in Western Europe and Asia/Pacific (excluding Japan). HP’s growth was propelled by an online promotion event and the expansion of tier-three channels that had allowed it to capture the growth in demand from the significant increase of new businesses in the SMB segment.

Dr. Sueling Wang, President of CI, and Mr. Reinhardt Jippa, JR Consulting, have agreed to join hands in expanding CI’s business in the EMEA region. DEFENDANTS REQUEST RETRIAL IN CANON CASE

Aftermarket supplies businesses Color Imaging and General Plastic Industrial have urged the courts to provide them with a new trial because the jury ordered them to pay “grossly excessive damages” to Canon.

Color Imaging, Inc. (CI), based in Georgia USA, and General Plastic Industrial Co., Ltd. (GPI) of Taiwan filed the order with the US District Court for the Northern District of Georgia, Atlanta requesting an “alternative remittitur”—where the judge reduces the damages awarded by a jury—or a new trial.

It only took a jury a few hours back in June to return a guilty verdict where CI and GPI were found to have “willfully infringed Canon’s patent No. 7,647,012.” Canon was awarded the full measure of damages, however, Canon asked the court to enhance the damages award by up to three times, which is permitted under the law.

According to the court filings, copies of which have been supplied to RT Media, “a patentee may be awarded “reasonable royalty” damages for the infringer’s sales. The royalty rate for these damages is based on the results of “a hypothetical negotiation between the patentee and the infringer at a time before the infringing activity began.” CI and GPI argue, “Royalties, like lost profits, are compensatory damages, not punitive.”

The motion for a reduction in the damages or a new trial argues the jury agreed with Canon that the defendants owed it ,740,604 based on a royalty rate of for each empty bottle the defendants manufactured, even though GPI only sold its empty bottles for .59. The defendants claim the verdict reflects a royalty award that was 566% of GPI’s gross profit and over 334% of GPI’s revenues.

Their motion requests a new trial for reasonable royalty damages, if “Canon refuses to agree to a reduction (remittitur) to 4,207.80” which they consider to be reasonable royalty damages.

HUGE COUNTERFEIT RAID IN GERMANY

Police have confiscated counterfeit toner cartridges worth ˆ10 million (US.9 million) and apprehended a gang involved in worldwide trafficking in Hesse, Germany.

According to hessenschau.de customs officials in Frankfurt arrested 24 people allegedly involved in the German-Iranian gang that manufactured and sold counterfeit Kyocera toner cartridges.

Police raided 24 residential and business premises in the Rhein-Main and North Rhine-Westphalia districts. At the same time, a company was searched in the Netherlands.

The 24 suspects range in age between 29 and 72. Three have been allegedly identified as the main ring-leaders: a 34-year-old man from Gross-Umstadt and two 48- and 52-year-old men of no fixed address in Germany.

Crime investigators found more than ˆ100,000 (US9,000) in cash as well as gold and valuables worth ˆ40,000 (US,450).

A Frankfurt customs officer explained the gang had bought empty toner cartridges in Europe that were then exported to Chinaand Dubai to be filled and returned again to Germany. Some of the toner cartridges were also filled in a production facility in Frankfurt and Dieburg. A network of businesses in Germany and The Netherlands then distributed the products declaring them to be new, original products from Kyocera. Cash from sales then flowed back to accounts of the perpetrators in Dubai.

Hans-Jürgen Schmidt, a Customs Office spokesman said, “At the current time, the amount of damages is hard to estimate. We expect it to run into the double-digit million range.”

In order to transport the confiscated products more than 20 shipments were made by freight train and road haulage trucks.

PELIKAN’S BUSINESS SELLS FOR MILLION

More details have emerged since RT Media broke the news about Malaysian-listed stationery group Pelikan which has been acquired by China’s Print-Rite.

The deal, worth US.98 million (RM30 million) sees Print-Rite pick up the Pelikan’s foreign printer consumable businesses in Germany,France, Czech Republic and China.

The declining volume and changes in the market have seen Pelikan suffer losses of about US.59 million in Europe as well as in China.

However the three subsidiary stationery businesses, Pelikan Hardcopy Production AG (PHP), Pelikan Hardcopy Distribution GmbH & Co. KG (PHD) and Pelikan France S.a.s, contributed US.65 million or 9.3% of the group’s revenue in the 2016 fiscal year.

Arnald Ho spoke exclusively to RT Media saying, “As you know, Pelikan was originally sold to the Malaysian parent company, but now Print-Rite has bought their global supplies business together with the two companies in Germany and France as well as a 30 year license to use the Pelikan brand for the hard copies supplies.”

According to theedgemarkets.com proceeds from the transaction will be used to cover the cost of staff terminations and plant closures, estimated to be US.26 million. The remaining will be used for working capital to wind-down operations of the disposed businesses.

 JADI TO SELL ITS PROPERTY

Malaysia-based toner manufacturer Jadi Imaging Holdings Bhd has decided to sell its freehold land as well as a detached factory-cum-three-storey office in Shah Alam.

According to klsescreener.com, the deal is predicted to be RM23 million (US.36 million). The company is said to have already entered into a sale and purchase agreement (SPA) with Tropical Fairyland Sdn Bhd.

Jadi claims that the money generated from the deal will be used for “bank borrowings repayment, working capital, estimated real property gain tax payable pursuant to the proposed disposal and defray estimated expenses relating to the proposed disposal.”

“The proposed disposal will enable Jadi Group to generate immediate cash flow and repay part of the group’s bank borrowings, which will reduce the gearing level of the group,” said Jadi Imaging.

The company also added, “This will also result in interest savings and provide financial flexibility to the group to secure additional borrowings should new investment opportunities arise.”

In addition to this, Jadi Imaging claims that the deal is expected to be completed by the fourth quarter of 2017.

Jadi Imaging shares remained at an unchanged closing price of 6.5 sen (0.02USD), with a market capitalization of RM 61.22 million (14.25 million USD).

 BROTHER PATENT DISPUTE SETTLED

Brother Industries. Ltd. announced the concluding settlement of a patent dispute with a distributor of toner and drum cartridges in Germany, after receiving substantial damage compensation.

The supplier had distributed a wide range of toner and drum cartridges that implemented patented technology of Brother, and had acknowledged it before the infringement action was filed.

The judgement issued in 2016 prohibits the distributor to offer, put on the market or use the toner and drum cartridges in dispute in Germany, or to import them into Germany or possess them in Germany for said purposes. Moreover, it established the obligation of the distributor to compensate damage and ordered it to disclose information.

After reimbursing costs and disclosed names of supplier and commercial customers and sales figures, Brother and the distributor have now arrived at an agreement on remaining claims.

 REPLACEMENT INK CARTRIDGES NOW LEGAL IN HOLLAND

A court in the Netherlands says the sale of replacement ink cartridges is permitted, even if the cartridges relate to an essential part of a patented invention.

The Court of Appeal at the Hague ruled in favor of Digital Revolution in a case brought on by HP.

According to Lexology, the court ruled the user of a printer “has an implied license to use the printer in a normal, well-functioning way, which includes the use of compatibles, provided that there is no protection for the cartridge itself.”

However, in practice, this ruling may have limited consequences, as the court also declared the result could be different if the consumer agrees to certain conditions at the time of purchasing the printer.

HP originally accused Digital Revolution of breaching its patent EP 2 170 617 (“EP 617”),  “because all elements of claims 1 and 2 were present in the cartridges offered by Digital Revolution.” This was rejected by the District Court of The Hague, because it found the claims to be invalid.

Lexology further noted, “In a later stage of the proceedings HP also argued indirect infringement of claim 7. This was also dismissed by the Court, because this additional claim was filed too late in the proceedings in violation of the principle of due process.” They continued, “In the appeal proceedings, HP again argued direct and indirect infringement. The appeal on the grounds of direct infringement was rejected by the Court of Appeal, because the Court found claims 2-6 and 13 of EP 617 to be invalid. “

Digital Revolution argued it does not offer or deliver cartridges to “anyone other than those authorized under the terms of Articles 55 to 60 (thus licensed) to apply the patented invention” as required by Article 73 DPA. The court agreed.

The case is expected to go before the Dutch Supreme Court.

 RICOH TO USE 100% RENEWABLE ENERGY BY 2019

Ricoh Asia Pacific has set the goal of being powered by 100% renewable energy in two years’ time.

According to the OEM, Ricoh Company, Ltd. announced the plan to become more environmentally friendly in April. The Singapore office for Ricoh Asia Pacific took the initiative by switching to 25% clean energy on the 20th June. They predict to be powered by 50% clean energy this time next year, and expect this figure to rise to 100% by 2019.

 CTI INKS USED FOR US STAMPS

The United States Postal Service (USPS) will be commemorating the solar eclipse by using Chromatic Technologies Inc. (CTI) inks on their stamps.

According to inkworldmagazine.com, the stamps will come equipped with a thermochromic ink that changes color when in contact with heat. The inks of CTI will allow users to alter the image of the solar eclipse through a simple touch of a thumb.

When the surface of the stamp is raised to 84°F. or higher, the lunar surface will appear. Similarly, when the temperature drops to 77°Fand below, it reverts back to the original dark image.

This technology has been exploited by companies such as MolsonCoors, Frito-Lay and Coca Cola since CTI’s inception in 1993. The thermochromic inks are uniquely formulated for use in screen printing, but CTI employs the same technology for use in flexographic, gravure and offset-printing processes. The thermochromic inks are available in multiple colors (and at various activation temperatures), and can also be adapted to change color when exposed to sunlight (photochromic inks).

The top 10 products the rest of the world wants from China include electrical machinery, computers and accessories, furniture, clothing, footwear and vehicles. Given China’s population of 1.4 billion people, the value of its 2016 exports translates to roughly US/lib/forExpo/virtex.php?lang=eng&eventId=7,500 for every resident in the country.
The printing consumables industry has also gained a strong foothold in China. Zhuhai, in southern China, has been named the printing consumables capital of the world with .65 billion of exports going to over 100 countries..
The Zhuhai brand, like the China brand, attracts thousands of businesses from around the globe to the more than 650 individual printing consumables companies located there. Many of these companies travel to events held around the world including PaperWorld in Germany, ITEX in USA and the RT Imaging Expos in Egypt and Mexico. An Egyptian visitor told RT Media today, “I gained around 20 new suppliers from the show in Cairo, mainly from China. Now I am making deals with some of them. In just two days RT Imaging Summit and Expo gave us a plate of gold.” Ayman Abdelbaset added, “Now I will visit China in 50 days, to follow up the great opportunities made during this expo.”
The Centre for Printing Consumables in Zhuhai reports 78.6% of ribbons, 68.4% aftermarket inkjet cartridges and 40.1% of aftermarket toner cartridges used in the world come from Zhuhai based companies.
Many of the individual printing consumables supplies companies in China area also busy going about developing their own brands as well. Four of them have floated their companies and allowed ordinary people, including Chinese, to be a part of their success as they grow domestically as well as internationally:

  1. Print-Rite, the first company to start the supplies business in China 35 years ago floated its subsidiary Zhuhai Print-Rite New Materials Corporation Limited in September 2016.
  2. Suzhou Goldengreen Technologies Ltd, the second largest OPC drum manufacturer in the world behind Canon reported in August 2016 that its public float at the Shenzhen Stock Exchange was oversubscribed 3,263 times.
  3. According to Reuters Hubei Dinglong, which was listed on the Shenzhen Stock Exchange in 2010 has a market capitalization just over CNY12 billion (USD1.8 billion) and is using the capital to roll up some of China’s better known, second-tier supplies companies and emerge as the region’s largest toner cartridge manufacturer.
  4. Apex Technologies which owns the Ninestar and Pantum brands, acquired the well know US brand printer manufacturer Lexmark in 2016 and pushed the brand into the top 5 OEM global printing brands behind HP, Canon, Epson and Brother. In 2015, Apex also acquired Static Control Components, arguably the best known supplier of cartridge components in the world, which is also based in the United States.

Top brand marketing gurus say that successful brands rely on experience as being the leading key factor that determines who will follow them.  FOUR OUT OF FIVE TOP HARDCOPY BUSINESSES ACHIEVED GROWTH

The worldwide hardcopy peripherals (HCP) industry has risen 1.2% in comparison to last year. Both inkjet and laser unit shipments were pivotal factors triggering the year-over-year growth, increasing 2.2% and 2.1%, respectively.According to Business Wire, over 23.4 million units were shipped in the HCP market in the first quarter of 2017 which is almost 300,000 units more than in the same period of 2016. Hardcopy peripherals include single-function printers, multifunctional systems (MFPs), and single-function digital copiers (SF DC).

Four out of the five top HCP businesses had year-over-year positive shipment growth. Epson had the greatest improvement at 5.6%, in second was HP Inc. at 3.0%. This was followed by Canon Group and Brother who both had a 0.6% growth.

In addition to this, color inkjet 1-10ppm devices rose 89.2% in total unit shipments. The driving factor for this exponential growth was the improvement across all eight of IDC’s regional markets, ranging from 50.5% to 248.6%.

Moreover, Epson attained a 6.9% year-over-year progression in the inkjet sector. This was achieved primarily through the utilization of their five L series models that were introduced last year.

Furthermore, HP Inc. had great success in China. They accomplished this through the expansion of their tier-three channels which benefitted the developing new businesses in the SMB segment. In fact, HP Inc. managed to achieve a 3.0% year-over-year growth in global shipments.

 CANON GRANTED PATENT INJUNCTION IN GERMANY

District Court Düsseldorf has granted Canon a preliminary injunction for patent infringement in Germany, according to Canon.

The M & S Vertrieb Service OHG was issued for the offer and distribution of laser toner cartridges comprising a drum unit via Amazon.de under Amazon Standard Identification Number B00I9BN11C, B00HFN56UE, B00IHWSUCS, B06WVB3JRW, B00IHXOQFW and B01BGQLB0O. Those cartridges replace the cartridge models HP CF226A, HP CE255X, HP CF280A, HP CF280X, HP CF287A, HP CE505A and HP CE505X compatible with HP laser beam printers.

The preliminary injunction granted by the District Court Düsseldorf is not yet final. Canon can enforce the decision after service of the PI on the Defendants.

 HP TEAMS UP WITH JAPANESE COMPANIES

HP’s 3D printing business has announced partnerships with Japan-based companies Mutoh Industries Ltd and Ricoh Japan Corp.

According to the OEM, these partnerships have occurred only one week after HP broadcasted its commercial entry into the world’s largest manufacturing market.

Not only are Ricoh and Mutoh bringing a geographically valuable relationship to HP, they are also set to open a 3D Printing Reference and Experience Center in Tokyo. This will showcase the HP Jet Fusion 3D printing solutions and allow them to converse and connect with customers.

Being a technological and manufacturing superpower, Japan is responsible for 10% of global manufacturing. It also plays a huge role in the advancement of technology by being a large developer of innovative electronic products.

What’s more, Japanese businesses have recently embraced 3D printing as it is an ever-growing market. According to data from IDC, it saw more than 104 percent in revenue growth from 2015 to 2016. It is expected to reach US0 million in sales by 2020.

Richard Bailey, president of Asia Pacific and Japan at HP stated, “We are on the cusp of a transformation in manufacturing, enabled by new technologies such as 3D printing, artificial intelligence and robotics,” he followed on by saying “We are excited to introduce HP’s commercial 3D printing solution to reinvent manufacturing in Asia-Pacific, delivering much higher speeds and lower costs while enabling on-demand, low-volume production.”

 AFTERMARKET SNAPS BACK AT FAKE NEWS

A reputable toner manufacturing company based in Malaysia has come under attack from a US based news agency, and now it plans to fight back. Jadi Imaging says the agency has made erroneous accusations attacking its brand. “Jadi Imaging Technologies will not stand still and allow Tonernews.com to discredit it in such a wrongful way. It’s time to speak up and take action,” a Jadi spokesperson told RT Media.

Jadi added, “Even in 2017, the legitimate aftermarket industry is still being criticized for condoning acts of counterfeit products. Now Tonernews.com is making the same accusation about Jadi.”

Jadi told RT Media that the company’s trade practices and business ethics are very clear on three key points:

·                                Jadi’s toner does not breach any OEM patents;

·                                Jadi’s toner is sold under its own private label;

·                                Jadi’s toner is not sold under the pretense of being an OEM branded product.

“The 3rd point is especially pivotal,” the company representative stated. “Counterfeiters intentionally sell their products in such a way that consumers believe they are purchasing genuine OEM branded products.”

“Jadi does not condone such actions and would like to emphasize that all parties take the initiative to honestly and truthfully understand the role of the legitimate aftermarket industry, which is present in many other sectors.”

Jadi Imaging is not the first aftermarket company to be affected by wrongful, damaging fake news published by TonerNews.

 CHINESE AFTERMARKET REMANUFACTURER SEEKS USITC OPINION

Ninestar, the well-known Chinese cartridge remanufacturer, has approached the US International Trade Commission (USITC) seeking an opinion about having some of its products excluded from current GEOs.

GEOs, or General Exclusion Orders, are set up to stop infringing products from entering the country following an investigation into printer OEM complaints by the USITC.

A reply was filed by Ninestar on June 1 in response to Epson’s opposition in May to its April request for an advisory opinion.

According to legal documents dated April 26, provided to RT Media, Ninestar Image Tech Ltd., Ninestar Technology Company, Ltd., and Apex Microtech Ltd. (Ninestar) requested the Commission to “issue an advisory opinion that their remanufactured Epson ink cartridges are outside the scope of the GEO and the Cease and Desist Orders of the 565 and 946 Investigations.”

Epson moved quickly to file a response with the USITC on May 8. They urged the commission not to provide an advisory opinion proceeding to Ninestar. “Even if Ninestar’s submission were sufficient,” Epson argued even though they stated their petition was inadequate, “Ninestar and its affiliates have a proven track record of fraudulently violating this Commission’s exclusion and cease and desist orders, including specifically under the guise of importing remanufactured ink cartridges.”

In its most recent June 1 submission to the USITC, Ninestar reminds the commission of the Supreme Court’s May 30 decision which “affects the application of the first sale doctrine in the proposed advisory action and how it simplifies the issues and need for discovery in the proposed advisory action.”

Ninestar is now requesting the commission to take these additional matters into account. In response to Epson’s opposition, Ninestar wishes this new information to be added to their original request for an Advisory Opinion from the USITC.

In May, the Supreme Court of the U.S.issued a ruling that a product’s patent rights are exhausted after the first sale. Further, the ruling takes effect irrespective of where that the first sale was conducted.

US COMMISSION AGREES TO ADVISE NINESTAR

The US International Trade Commission (USITC) has agreed to institute an advisory action regarding remanufactured cartridges based on a petition by Ninestar back in April this year.

This is in despite of a fiery request by Epson for the commission not to provide an advisory opinion. That request, on May 8, argued Ninestar’s petition was inadequate and reminded the commission “Ninestar and its affiliates have a proven track record of fraudulently violating this Commission’s exclusion and cease and desist orders, including specifically under the guise of importing remanufactured ink cartridges.”

Epson’s request appears to have been disregarded. In June 13 the USITC assigned the task of providing the advisory opinion to Ninestar to Administrative Law Judge Shaw (pictured).

RT Media has been advised ALJ Shaw could issue an initial advisory opinion within 3-6 months. But, the final timing could be extended as required.
