Gardner to Speak at Static Control’s Kick-Off Seminar in Poland
Sanford,
N.C. – (April 23, 2014) – Lexmark’s Worldwide Brand Protection Manager Andrew
Gardner will be speaking at Static Control’s free seminar in Lodz, Poland at Andel's Hotel Łódź on Friday, April 25. Gardner
will discuss clone cartridges from the OEM perspective.
This seminar is the first in a series of 22
information-intensive sessions to be held throughout Europe and Central and
Western Asia during 2014. Each seminar is targeted toward the demands of each
particular market and tailored to suit local remanufacturers.
Lexmark joins HP as the second OEM to recognize Static Control as a leader in the imaging aftermarket
and a partner in the fight against counterfeit and clone cartridges.
Lexmark has a vested interest in Poland, as they
manufacture toner cartridges in Zary, Poland. In his presentation, Gardner
plans to cover clones in detail, including the raids that occurred earlier this
year at RemanExpo@Paperworld in Germany, where infringing MS series cartridges
were seized from exhibits.

Supreme Court's Decision Favors Static Control
A latest ruling from the United States Supreme Court holds that Static Control Components has the right to sue Lexmark on grounds of false advertising arising out of Lexmark’s Prebate program.
The decision was approved by all 9 justices in the Supreme Court. According to Justice Antonin Scalia, “…Static Control adequately alleged proximate causation by alleging that it designed, manufactured, and sold microchips that both (1) were necessary for, and (2) had no other use than, refurbishing Lexmark toner cartridges. It follows from that allegation that any false advertising that reduced the remanufacturers business necessarily injured Static Control as well.”
Lexmark first sued Static Control in 2002. It was initially successful in having the trial court throw out Static Control’s counterclaims against Lexmark. The case went to trial in 2007 with a jury verdict in Static Control’s favor. After trial, Static Control successfully convinced the Sixth Circuit Court of Appeals to reinstate Static Control’s claims for Unfair and Deceptive Trade Practices and false advertising. Lexmark petitioned the Supreme Court to reconsider. The Supreme Court rejected Lexmark’s request.
Static Control’s claims against Lexmark are based, in part, on Lexmark falsely telling remanufacturers that remanufacturing “Prebate” cartridges was illegal. The Lanham Act, a federal statute, prohibits false advertising. The trial court initially rejected Static Control’s Lanham Act claim, but the Sixth Circuit reinstated it. Lexmark asked the Supreme Court to overrule the Sixth Circuit.
“We are extremely pleased the Supreme Court agrees Lexmark should be held accountable for its actions,” said President Bill Swartz. “I only wish Ed, our founder, my father, were here to enjoy this victory with us.”
William London, Static Control’s General Counsel, added, “The Supreme Court’s unanimous decision should send a strong message to Lexmark. We plan to move forward with our false advertising suit against Lexmark and prove we were damaged by Lexmark’s false advertising.”

SCC Expands Delivery Coverage in Eastern Europe
Static Control Components (SCC) announced its distribution center in Butzbach, Germany will expand its delivery area to include Poland, Slovakia, Slovenia, Croatia, Hungary and the Czech Republic. The center currently delivers only to Germany, Austria and Switzerland.
SCC noted that the center opened in July, 2013 to provide genuine remanufacturers in German speaking countries with dedicated logistical resources. Now the center will offer the same services to the additional delivery area.
“We are emphasizing a deeper customer experience by offering more local logistical support. Static Control Components (SCC) announced that 66 of its toner SKUs have
been granted the Nordic Swan Ecolabel. In addition, SCC’s customers can now
apply for a license to place the Ecolabel on remanufactured cartridges using the
recognized toners.
SCC said it
manufactures products under the environmental standard ISO 14001:2004 and the
latest recognition shows its commitment to environmentally-friendly products
and practices.

commented, “The Nordic Ecolabel offers a valuable way for our customers to
differentiate themselves from their competition. It communicates less waste,
lower consumption of energy and raw materials, and high standards of quality

Static Control Sees a Positive Start to 2014 at
RemanExpo@Paperworld, Frankfurt
SANFORD, N.C. – (February 6, 2014) – Static Control exhibited once again
at January’s RemanExpo@Paperworld, which took place at the Messe Frankfurt,
Germany. Paperworld is Europe’s largest trade show
for the office supplies and stationery industry, which this year had an
estimated attendance of more than 45,000.

Control’s booth focused on COLORCONTROL
Replacement Imaging Systems, which was supported with videos, product displays,
brochures and posters. A popular feature was the technical area that
demonstrated the exceptionally high print quality and consistency that COLORCONTROL delivers.

Static Control Optimistic Over False Advertising Lawsuit Against Lexmark
The U.S. Supreme Court has heard oral arguments regarding the case between Lexmark and Static Control Components. The court has yet to rule who can sue for violations of the federal false advertising statute.
Static Control said, “A decision will not be made for months, but the leaning of the court strongly favored another win for Static Control.” The company’s claims against Lexmark are based, in part, on Lexmark falsely telling remanufacturers that remanufacturing “Prebate” cartridges was illegal. The Lanham Act, a federal statute, prohibits false advertising. The trial ourt initially rejected Static Control’s Lanham Act claim, but the Sixth Circuit reinstated it. Lexmark asked the Supreme Court to overrule the Sixth Circuit.
Early on in the argument, things favored Static Control. Justice Sotomayor interrupted Lexmark’s lawyer stating: “You’re disparaging the goods of a person. You’re saying that it’s illegal to use that person’s products. It seems to me that’s the essence of the Lanham Act as it’s now written.”
Justice Ruth Bader Ginsburg also seemed to favor a ruling for Static Control, commenting: “Here is an entrepreneur that says, ‘We make a product and Lexmark is disparaging our product. It is essentially trying to get us out of this line of business. Certainly if you just read the words of the Lanham Act, this is allegedly false advertising.”
“We are extremely pleased with how things went today,” said Static Control’s President Bill Swartz. “We look forward to the court’s decision in June.”

the Iberiaregion, effective Oct. 14.
Montero joins the company bringing six
years of industry experience, having previously worked as an Account Executive

System Offering for Samsung MLT-D101 Cartridges Available From Static Control
SANFORD, N.C. – With the recent release of a replacement doctor blade and developer
roller, Static Control now offers a complete system offering for remanufactured
Samsung MLT-D101 cartridges. This system offers remanufacturers everything they
need to provide OEM-like consistency and page yield to end users. These popular
cartridges are used in a wide range of printers available from Samsung,
including the ML-2160/2165/2168, the SCX-3400/3405 MFPs and the SF-760SP MFP.
The complete system includes replacement
toner, chips, drum, developer roller, doctor blade and wiper blade. Static
Control’s system offering uses 22 percent less toner than other aftermarket suppliers,
while delivering OEM-stated page yields and OEM-like image density.
Replacement of the doctor blade and
developer roller for each remanufacturing cycle is vital for optimal
performance. These delicate components can easily be damaged during cleaning,
leading to print defects. Static Control’s doctor blade and developer roller
deliver OEM quality and performance throughout the life of the cartridge when

SANFORD, N.C. – On August 29, 2012, the 6th Circuit
Court of Appeals again ruled in Static Control’s favor in the long-running
dispute with Lexmark. The Court of Appeals reinstated Static Control’s claims
against Lexmark under the Lanham Act and North Carolina state antitrust laws. The Lanham Act
claims are for false advertising arising out of Lexmark’s claims that the
remanufacturing of Prebate-program cartridges infringed Lexmark’s patents. The
antitrust claims arose out of various Lexmark actions to reduce the number of
cartridges remanufactured by third parties. The Court of Appeals also rejected
Lexmark’s attempts to overturn the jury’s verdict rendered in Static Control’s
favor and upheld the trial court’s finding that two of Lexmark’s design patents
were invalid.
“When we were sued in 2002, I stated that we were in
the first round of a prize fight,” said Ed Swartz, founder and CEO of Static
Control. “We have won each round since, and we will win the fight at the end.
The jury found for us because what Lexmark did to us was wrong. The Court of
Appeals found for us because they agreed.”
This is the second time that the 6th Circuit Court of
Appeals ruled in Static Control’s favor in the 10-year-old fight. In 2004,
Static Control appealed a finding that its chips violated the Digital
Millennium Copyright Act, commonly known as the DMCA. The trial court had found
that Static Control’s sales of chips, which could communicate with Lexmark’s
printers, violated the DMCA. The 6th Circuit reversed the trial court verdict
and held that the DMCA could not be used to prevent the use of chips to
communicate with printers.
The case now goes to a trial on Static Control’s
claims against Lexmark. “We have waited a long time to present our case on why
Lexmark’s actions are unfair and illegal,” Swartz said. “Lexmark had their turn
at bat, and now it is our inning. We are confident the jury will agree with us
and award us the damages we are entitled.”

Lexmark
Awarded Preliminary Injunction Against Static Control
Following a hearing on Feb. 7 and several weeks of
deliberations by the judge, Lexmark was awarded a preliminary injunction in the
lawsuit it filed against Static Control Components on Dec. 30, 2002.
The decision, released Feb. 27, was made by Judge Karl
Forester of the Lexington, Ky., District Court. This means that Static
Control will not be allowed to sell the T520/620 chips in question until the
lawsuit is concluded. The lawsuit is expected to last several years. During the
injunction hearing two weeks ago, Bill Swartz of Static Control testified that
the company projected losses of millions of dollars over the next two years if
the chips could not be sold.
"We are disappointed in his order, and believe
that after he or a jury has heard a full exposition of the facts that we will
prevail," Charles Taylor of Static Control Components said in a statement.
"Judge Forester has signed a 53-page order in this matter, and naturally
we are still studying that order. Nevertheless, we think that the judge has
given us guidance in this matter so that we will be able to offer a replacement
Lexmark 520/620 chip that fully complies with his order. This should take place
in a very few weeks."

Control Responds to Supreme Court Decision to Hear Lexmark International Inc.
v. Static Control Components Inc.
SANFORD,
N.C. – The Supreme Court agreed to hear Lexmark International Inc.’s appeal of Lexmark International, Inc. v.
Static Control Components, Inc., the August 29, 2012 decision of the U.S.
Court of Appeals for the Sixth Circuit that reinstated three of Static
Control’s unfair competition counterclaims against Lexmark.
Although
the legal disputes between Lexmark and Static Control have centered primarily
on allegations by Lexmark of patent infringement, copyright infringement, and
violations of the Digital Millennium Copyright Act, none of those issues is
involved in the case before the Supreme Court. All of the jury verdicts
in favor of Static Control and against Lexmark on those claims remain final. The
Court’s action also does not affect the district court’s determination that
Lexmark’s “Prebate” program is not enforceable as a patent license under patent
law, a decision that the Sixth Circuit let stand.
The
question that will be heard by the Supreme Court is limited to the legal issue
of when a company has the legal right, known as “standing,” to assert a claim
for false advertising under the federal law known as the Lanham Act. Different
courts of appeals historically have applied different tests. Several
courts (the Seventh, Ninth, and Tenth Circuits) apply a “categorical” test
giving standing only to competitors. Three other courts (the Third,
Fifth, and Eleventh Circuits) apply by analogy the same test courts use to
evaluate antitrust claims. The Sixth Circuit and the Second Circuit look
to whether the plaintiff can demonstrate a “reasonable interest” that is
protected under the Lanham Act.
William
London, Static Control’s general counsel, reacted to the Court’s decision
today: “Static Control’s counterclaims allege that Lexmark targeted Static
Control’s products with false advertising statements, and as a result Static
Control incurred harm to its business and goodwill. This is precisely the type
of conduct that is prohibited by the Lanham Act, and past case law affirms
Congress’s intention in such circumstances to protect companies like Static
Control. While Static Control regrets that the Court chose this case as the
vehicle to clarify the differences among the tests applied by the different
courts of appeal, we are confident that at the end of the day Static Control
will continue to have standing to pursue its claims and obtain redress for the
harms caused by Lexmark’s unfair competition and anticompetitive practices.”
The
Sixth Circuit’s August 29, 2012 opinion also found that Static Control was
entitled to pursue its counterclaims against Lexmark for antitrust violations
and false advertising under North
Carolina state law. Those claims are not
affected by the grant of certiorari by the Supreme Court. The Sixth
Circuit case is Static
Control Components, Inc. v. Lexmark International, Inc., 697 F.3d 387 (6th Cir. 2012).

Control Supports PACTO Association in Its Fight Against Clone Manufacturers
Reading, UK –Static Control is proud to
announce its support of the Italian association Produttori Associati Cartucce
Toner (PACTO). The association comprises members from Sapi, Microlaser Italia,
Tecnolaser Europa and Eco-Recuperi.
Established
in 2009, PACTO aims to promote any initiative that helps to support the
development and progress of the Italian remanufacturing industry. PACTO states
that genuine remanufacturers currently hold a 10% share of the 8-9 million-unit
cartridge market in Italyand that crucially, the government accounts for approximately 3 million of the
total market sales.
PACTO
associates met at Static Control’s headquarters in Sanford, North Carolina,
USA in March
and discussed their goals, one of which is to target government bodies and
raise their awareness of the industry’s fight against new build/clone
manufacturers. They are also working with the Ministry of the Environment to
promote the industry’s contribution to the green economy, and ultimately
promote awareness to the general public of the positive and green contributions
the remanufacturing industry makes.
PACTO
is the most recent in a line of cartridge associations stepping up their
efforts to differentiate themselves from new build/clone manufacturers.

Control Releases Statement Regarding Recent General Exclusion Order
SANFORD, N.C.– On June 28, 2013, the United States International Trade Commission issued a
General Exclusion Order (GEO) prohibiting the importation of products that
infringe two U.S.patents belonging to Canon, numbers ‘803 and ‘454, which cover the design of
the gears used on the OPC drums in hundreds of Canon and HP cartridge
SKUs. The GEO concludes various legal actions which began in January 2012
against more than 30 manufacturers, importers and distributors of toner
cartridges and OPC drums and ushers in a new phase of enforcement.
Static
Control recognized the potential threat of patent infringement and successfully
developed a unique, fully functional gear designed to eliminate any risk of
infringing Canon’s gear patents. We filed for patents in 2007 and two U.S. patents
for non-twisted gears were issued to Static Control in October 2010 and
December 2011. Our ZeroTwist Gears were the first-to-market solution for
remanufacturers and are still the only solution protected by
multiple U.S.patents.
As
we have stated for more than 18 months, our gears are safe and will not be
impacted by the GEO. We take all patents extremely serious and respect the
intellectual property of the OEMs through the development, engineering and
